1. Purpose

These Terms of Service (hereinafter referred to as "these Terms") set out the conditions and procedures for the use of the online community service provided by AUWith (hereinafter referred to as "the Service"), and the rights, obligations, and responsibilities between users and the Service. These Terms are governed by the laws of the Commonwealth of Australia, including the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2).

2. Definitions

  1. "Service" means the Australia settlement community portal operated by AUWith.
  2. "User" means any person who agrees to these Terms and uses the Service.
  3. "Member" means a User who has registered an account with the Service.
  4. "Content" means any posts, photos, comments, and other material submitted by a Member to the Service.

3. Effectiveness and Amendment of Terms

  1. These Terms become effective when posted on the Service or otherwise notified to Users.
  2. The Service may amend these Terms where necessary. Any amendments will be announced via the notice board at least 7 days prior to their effective date. Continued use of the Service after the effective date constitutes acceptance of the amended Terms.

  1. The Service provides the following features:
    • Regional community forums (jobs, property, marketplace, etc.)
    • Australian lifestyle information and Q&A
    • Deals and discount information
  2. The Service may modify or discontinue all or part of the services provided for operational or technical reasons, with reasonable notice where practicable.

5. Registration and Accounts

  1. Registration is available via email address or Google account.
  2. Members must provide accurate information. Use of the Service may be restricted if false information is provided.
  3. Members are responsible for maintaining the security of their accounts. Accounts may not be transferred to or shared with others.

6. User Obligations

Users must not engage in the following conduct:

  • Misappropriating the personal information of others or posting false information
  • Interfering with the operation of the Service or using the Service by abnormal means
  • Publishing content containing profanity, defamation, discrimination, or hate speech that infringes upon the rights of others
  • Using the Service for advertising, spam, fraud, or other abusive purposes
  • Any conduct in breach of applicable laws, including the Criminal Code Act 1995 (Cth) and state/territory legislation

7. Content Management

  1. Copyright in Content remains with the author. The Service may use Content within the scope necessary for operation of the Service.
  2. Content may be removed without prior notice if it:
    • Violates applicable laws
    • Defames or infringes upon the rights of others
    • Is contrary to public order or accepted standards of morality
    • Contains fraudulent listings, scams, or otherwise deceives users

8. Limitation of Liability

  1. The Service is not responsible for transactions or disputes between users.
  2. The Service does not guarantee the accuracy or reliability of information posted by users.
  3. The Service is not liable for service interruptions caused by force majeure events, including natural disasters or technical failures beyond reasonable control.

Australian Consumer Law Notice: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement. If the Australian Consumer Law applies, and the Service fails to comply with a consumer guarantee, you may be entitled to a remedy including a refund, replacement, or compensation for reasonably foreseeable loss or damage.

9. Restrictions and Sanctions

The Service may take the following measures against Users who breach the obligations under Section 6 or violate applicable laws:

  1. Deletion of, or restriction on the visibility of, content (Section 7)
  2. Temporary suspension or permanent termination of account access
  3. IP-based restrictions to prevent evasion of sanctions — sign-up, login, and the creation of posts and comments may be restricted for IP addresses used by a sanctioned account. Viewing pages is not blocked. A registered restriction may remain in place until an appeal is upheld or an administrator decides to lift it.
  4. The registration of IP-based restrictions may be assisted by automated procedures. However, where an IP address appears to be shared by multiple users (such as cafés, universities or carrier networks), automatic registration is withheld and the matter is reviewed individually by an administrator.
  5. You may appeal a sanction via the Contact page; an administrator will review your appeal and respond. Where an appeal is substantiated, the sanction will be lifted.

This Section was announced on 2 July 2026 and takes effect from 9 July 2026.

These Terms of Service are effective from 1 March 2026.
